1. Definitions
(a) “The company” shall mean Tiles To You Ltd,.
(b) “The customer” shall mean any person, firm or company to whom the Company agrees to sell “the Goods.”
(c) “The Goods” shall mean the goods (and any parts Thereof) the subject matter of the contract as described in these conditions and (if appropriate) on the face of the Company’s acknowledgement of order form;
2. Variations.
The Goods are supplied within the manufacturers tolerance limits of size texture and colour variations. Due to the manufacturing process of tiles, orders may not be identical in shade to other batch numbers previously supplied. It is the responsibility of the purchaser to check goods supplied before fitting as no claim can be accepted once goods supplied have been fitted.
3. Comparison with previous orders.
Due to the manufacturing process of tiles and their batching, the company cannot guarantee to match shades of previous orders.
4. Crazing On Ceramic Tiles
Due to the manufacturing process of tiles no guarantee can be given against crazing.
5. Quotations & Prices
(a) Prices quoted in the quotations or price lists are those then current and shall not be binding on the company. Price increases that are beyond the Companies control will be passed on to the customer.
(b) Freight to the nearest freight depot used by our supplier is extra to the listed price.
(c) Quotations; on request quotations will be issued to the Customer—a full breakdown of costs including, list price, freight and any extra items will be fully displayed. The quoted sum will include GST.
6. Catalogues etc
Any description of the goods appearing in the Company’s brochures or website is believed to be correct and current but is not warranted by the Company. Where any such publication has been complied from information supplied to the Company by any supplier or manufacturer the Company accepts no responsibility for the accuracy of any such descriptions.
7. Samples
(a) Samples are available free of charge but is limited to 4 samples to any single enquiry any further samples required will attract a postage and handling charge.
(b) Sample size is 100mm x 100mm.
8. Delivery.
(a) All goods supplied by the Company shall be delivered to the nearest cartage depot used by our supplier. It is the Customers responsibility to take the goods to their address or construction site.
(b) Any dates quoted for delivery are approximate only and the Company shall not be liable for any delay in delivery that is beyond their control.
(c) If the Customer fails to take delivery of the Goods or fails to give the Company adequate instructions for delivery, the Company may charge for redelivering the Goods.
9. Refunds and returns
(a) The Company does not operate a returns policy.
(b) If the products you buy from us are faulty we will of course meet our obligations under the Consumer Guarantees Act and replace them. If you have merely changed your mind about a particular purchase the situation is different and no refund will be given and no returns accepted. Under the consumer Guarantees Act we do not have to provide a refund to you, so please choose carefully and take advantage of our free sample offer.
10. Risk
The risk in the Goods supplied by the Company shall pass to the Customer when uplifted from our supplier’s designated terminal depot.
11. Claims
(a) Any claims as to the condition of the Goods on delivery and which would be apparent on visual inspection must be communicated within two days of delivery via our contact facility on the web site.
(b) After three days from delivery the Customer is deemed to have accepted the Goods as having been supplied in good condition, and in accordance with the order.
(c) Because tiles are an easily broken item it is normal for some consignments to have the odd broken or cracked tile, these in most cases can be used for cuts. In larger orders we will include extra tiles to cover such eventualities.
(d) No claim may be made in respect of defective condition of Goods once they have been used by fixing to the wall/floor or by any attempt to fix the same to the wall/floor.
12. Acceptance
Acceptance of the Goods or payment for the Goods by the Customer to the Company shall of itself constitute an acceptance of these conditions.
13. Payment
Payment is required prior to the Goods being consigned to the Customer.
